Abstract

The subject of the study is composed of the notion of the assignment of claims and the legal conclusions arising from the assignment. The obligations of the person assigns his claim in return of remuneration from the presence of the claim and ability to pay of the obligator, are the basis of the study in especial. The aim is to clarify that how extended legal obligation of the assignor regulated by the new Civil Code shall be reflected to the practice with the light of comments of the Code.In this study, methodically, the subjects under debated are evaluated in terms of Turkish legal system by taking into consideration the new legal regulations, and a study based on the doctrine and practice is aimed with the contribution of the jurisprudence.We consider that the study shall contribute to clarify the topics regarding the notion of the assignment of claims and the liability of the assignor arising from the assignment in the Turkish Obligations Law
