Abstract

In our thesis titled "The Effect of the Termination of the Construction Contract in Return for Flats on the Legal Status of the Third Parties Entitled to the Contract", firstly, general information about the construction contracts in return for flats is given, and then, depending on the contracts established with the landowner and the contractor who are the parties of the construction contract in return for flats, it is tried to explain in what ways the third parties may have rights from the construction contract in return for flats. In the last section, the legal status of third parties in the event that the landowner rescinds or terminates the construction contract in return for flats is analyzed, taking into account the principle decisions of the Court of Cassation regarding the distinction between the forward and retroactive effect of the termination of the contract.
