Abstract

Narcotic drugs and psychotropic substances having the effect of drug addiction on people, led illicit drug traffickers to establish organized crime entreprises for the purpose of generating monetary profit. Because the crime organizations related to illicit drug trafficking having gross financial power, technical equipment and expert team, states encouraged to combat against illicit drug trafficking in mutual assistance since each state is unable to combat alone with criminal organizations. 1961 Single Convention, 1971 Convention on Psychotropic Substances and 1988 United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances are the essential international convetions in combating illicit drug trafficking. The most important routes in the world followed by the illicit drug trafficking are triangular route drawn by Laos ,Thailand and Myanmar that is called `golden triangle?; and crescent-shaped route drawn by Afghanistan, Pakistan and Iran, that is called `golden crescent?. Turkey is on the way of transit passage of the world's major drug routes. Turkey, by taking into consideration the international conventions and protocols related to drug trafficking has enacted the terms of international conventions related to narcotic drugs and psychotropic substances in Turkish Penal Code and relevant legislation. Turkish Penal Code numbered 5237, which has reformative characterictic in criminal law, was adopted on 26.09.2004 and the amendments have been made at times. The thesis deals with illicit narcotic drugs and psychotropic substances; and also drug abuse. It also embodies effective remorse law; drug treatment and probation; as an exception of non bis in dem rule in international law, the calculation of foreign jurisdiction penalty in Turkish jurisdiction penalty; mutual legal assistance against illicit drug trafficking; and controlled delivery.
