Abstract

The subject of our study is, the distress of house which is a kind of distress to be transacted according to the execution and bankruptcy law. Our study consists five chapters except introduction and conclusion sections. In the first chapter; introduction, concept and terminology of distress, in the second chapter; concept of not attachablity and general unattachable rights and receivables, in the third chapter; distress of house, the principal of unattachability for the house that is appropriate to debitor and the family of the debitor, the immovables that are acceppted as domestic building and what the rights are, the exceptions of distress of house appropriate to debitors conditions. In the fourth chapter; procedure against the operation in case of the house distress and the irrevocability of complaint period, determination of unattachability attribution and the condition of house in terms of ICRA crime is analysed. Finally in the fifth chapter general assesment has been made pertaining to this study.
