Abstract

The new social security concept, seen as a reform, is tried to be built on the formation of the principle of a monolithic system in the aspects of both institutional and legal arrangements. Providing a clarification for the form it takes in the changing social security system and in necessary situations determining the positive and negative changes of the optional insurance, which has an important place in the social insurance law, by comparing it with the previous system, is the purpose of our thesis. This thesis consists of introduction, three main sections and result parts. In the introduction part a general information is given about the subject. In the first part, the principle of compulsory insurance, which rules our social insurance system, is explained; as being the basic concept of our work, the social insurance is emphasized and compulsory insurance states in the Turkish Social Security System are analysed. The concept of optional insurance, determining the people who will benefit from optional insurance, the groups that can have optional insurance which should be investigated specially, the starting time of the insurance, the state of simultaneity in compulsory and optional insurances are the subjects of the second part. In the third section which is the last part of our thesis, the optional insurance premiums, payment, the situations in which the optional insurance becomes invalid and the consequences of having optional insurance are evaluated. In the conclusion part, our views about the changes, created in the optional insurance institution, which are foreseen with the new regulation are generally discussed.
