Abstract
Bu çalışma, başta Almanya olmak üzere Avrupa Birliği'nde uygulanan "İnkasso Sistemi'nin" temellendiği yasa ve uygulamalara kapsamlı bir bakış atmak ve bu sistemin Türk Hukukuna uyarlanabilirliğini incelemek için hazırlanmıştır. Bunu değerlendirebilmek için, öncelikle alacak tahsilâtı konusunda Alman hukukunda alternatif bir yol olarak öngörülmüş inkasso sistemiyle, Türk hukukunda yer alan Varlık Yönetim Şirketleri ve Faktoring Şirketleri incelenecektir. İnkasso, Avrupa ülkelerinde vadesi dolmuş alacakların tahsilâtında kullanılan uzlaşma sisteminin, genel bir kelimeyle ifade edilmesidir. Para alacaklarında alternatif uyuşmazlık çözüm yolu olarak adlandırabilen bir sistemdir. Öncelikle Avrupa ülkesi olan Almanya'nın inkasso sistemi ve inkasso sisteminin hukuksal altyapısı tanıtılacaktır. Karşılaştırmalı olarak Türk hukukunda yer alan Varlık Yönetim Şirketleri ve Faktoring Şirketleri tanıtılacak ve üçü arasındaki benzerlikler ve farklılıklar gösterilecektir. Türkiye'nin en çok ihracat yaptığı İngiltere, İtalya ve Fransa gibi Avrupa ülkelerindeki inkasso sistemleri son bölümde tanıtılacaktır. Bu çalışmanın amacı yıllardır Avrupa ülkelerinde başarıyla kullanılan, ekonomiye ve yargı organlarına destek sağlamış inkasso sisteminin bu ülkelerde nasıl ortaya çıktığını ve nasıl yürüdüğünü detaylı bir şekilde araştırıp Türk hukukunda bu sisteme benzer uygulamalarla karşılaştırıp, neden ve sonuçlarıyla inceleyip, gelecekte yapılacak daha kapsamlı çalışmalar için bir ilk adımdır.
The purpose of this study is to examine the debt collection system that is mainly used in Germany and in the European Union and according to this system analyse the adaptability to the Turkish law. First, in order to assess this, the author will examine the debt collection system in German law which is an alternative way to recover claims and Asset Managment and Factoring Companies in Turkish law. However what exactly is the debt collection system? The german word "Inkasso", expressed in the collection of overdue receivables as a reconciliation system the debt collection system in one word. A way to get claims with an alternative dispute resolution system. This study will cover by introducing the german Inkasso system as well as the law behind this system. Furthermore, the author will compare between the comparative Asset Management Companies and Factoring Companies and summarize the major similarities and differences of these three systems. In the last section of the study, the author is going to present the Inkasso system of the Turkey's major trading partners as England, Italy and France. The aim of this study is to give the reader an overview about this successful system, which is used for many years in Euopean countries and supported the economy and judical organs. How was this system established and which methods were used? Are there similar systems in the law of Turkey? These questions will be analysed in detail and the solutions are going to be the first step of further extensive studies in the future.
