Abstract

The subiect of this study is ?Incidental Pleas that Surety may claim from a Creditor? This study is compesed of 3 chapters except the introduction and condusion parts main heading. In this study under the second the suretyship contract and indicidental pleas derived from main debt relationship that a surety may claim from a creditor will be examined. Incidental pleas derived from main debt relationship that surety may claim from a creditor will be examined in two chapters as incidental pleas in a limited sense and the other incidental pleas. Under the third main heading indicental pleas that may be claimed to the creditor which may arise from the suretyship contract of the suarty. This chapter will be handled as incidental pleas in a limited sense and other incidental pleas. Under the forth head title , the results of not claiming the incidental pleas that the surety and debtor have and incidental pleas, belonging to the main debtor, which the surety cannot claim will be examined.
