Abstract

The subject of the thesis , postphonement of intitiation of public prosecution which is the new intitution in Turkish Law and influences of this postphonement in our law system. Until 2005, postphonement of intitiation of public prosecution is anfamiliar for Turkish law system. This intitution is firstly brought in Turkish law by number of 5395 Child Protection Code. After amendments by number of 5271 lawrules of procedure in the criminal law, this intitution is to start to been practised for adult with children . Besides, postphonement of intitiation of public prosecution that amendmends is brought by cod 5560 is characterized, comparing with like other intitution, analysed defects in practise. This thesis consist of three chapters, which are introduction, discussion and results.In the introduction chapter; generally postphonement of intitiation of public prosecution. n the discussion, part 1, postphonement concept and types; in part 2, principles about postphonement of intitiation of public prosecution; in the part 3, the sentence of postphonement of intitiation of public prosecusion. n the results, analysis of amendments which should be done and technical nessesities for the the intitution can be practised properly is summerised.
