Abstract
Finansal kiralama sözleşmesinde esas olan, sözleşme süresince, kiralanan malın kiracının zilyetliğinde bulunmasıdır. Ancak bazı şartlar çerçevesinde, kiracı, kiralananın zilyetliğini bir başkasına devredebilecektir. Devretmeme yükümlülüğünün olduğu hallerde de bazı yaptırımlara maruz kalacaktır.Kiralayan da kural olarak kiralananın mülkiyetini devretmeme yükümlülüğü altındadır. Ancak kiralayanın bu yükümlülüğüne de bazı şartlar altında istisnalar getirilmiştir. Kiracının kiralananın zilyetliğini, kiralayanında kiralananın mülkiyetini hangi şartlarda devredebileceği devretmeme yükümlülüğünün yaptırımları, mülga Finansal Kiralama Kanunu ve 6361 Sayılı Finansal Kiralama, Faktöring ve Finansman Şirketleri Kanunu karşılaştırılarak incelenecektir.
The fundamental of financial leasing contract is that leased goods are in leaseholder’s possession during contract period. Yet, only in certaion conditions, the leaseholder can transfer the possession of the lease to another. The leaseholder will beex posed the certain entforcements in case of obligation of non transference. As a rulet he leaser under the obligation of non transference of the leased property. Nonetheless, there are some reservations from this obligation of the leaser under the certain circumstances. The conditions under which leaseholder can transfer possession of the lease and under which the leaser can transfer of the lease, entforcements of obligation of non transference will be reviewed after comparison of obsolete Financial Leasing Law and 6361 nubered Financial Leasing, Factoring and Financing Companies Law
