Abstract

The main subject of thesis is construction contracts in return for independent units. These contracts, which we see under different names are basically bilateral hybrid contracts, under which the land owner makes his/her payment to the contractor by giving a share of his property in return for construction expenses. The main purpose of this thesis is to analyze the inherent conflicts and to provide suggestions to minimize claims in these types of contracts, which are widely used in Turkey, but which have not been accurately defined by law. The thesis is based on the analysis of real cases. Some of the cases have been settled, while some are still under litigation. The thesis investigates the sources of conflicts in each case and attempts to suggest contractual clauses that might contribute to the solution of a potential dispute before resorting to litigation.
