dc.description	The lexical meaning of reciprocity is to guarantee the acquirance of a right by expecting a response and it is the one of the most important condition for enforcement. This condition can actualise by three ways; contractual, legal and actual. The state which the enforcement of a decision was adopted must have one of these three types of reciprocity in its relations with Turkey. Only by this way, the other conditions of enforcement can be examined. The main subjects of this thesis are the status of this condition which is not required for recognition of the court decision and is very important for enforcement, among other conditions, the problems in practice about the detention of the reciprocity, the relationship between the types of the reciprocity and the doctrinal arguments about if this important condition must be stipulated or not for reciprocity institution in Turkish law from the past to the present.	tr_TR
dc.description.abstract	Karşılıklılık, kelime anlamıyla bir hakkın sağlanması için karşılık beklenmesi anlamına gelmekte olup, tenfiz açısından aranan koşulların en önemlilerinden birisidir. Bu koşulun akdi, hukuki ve fiili olmak üzere üç şekilde gerçekleşebilmesi mümkündür. Tenfizi talep edilen kararın alındığı devlet ile Türkiye arasında mahkeme kararlarının tenfizine yönelik olarak üç karşılıklılık türünden birinin bulunması gerekmektedir. Bu durumda diğer tenfiz koşulları incelenebilecektir. Çalışmamızın konusunu esas itibariyle, yabancı mahkeme kararının tanınması açısından aranmayan ancak tenfizi açısından aranan bu koşulun diğer tenfiz koşulları içindeki yeri, karşılıklılığın tespiti konusunda uygulamada yaşanan aksaklıklar ve tenfiz müessesesinin Türk hukukunda ortaya çıktığı günden bugüne kadar bu koşulun aranıp aranmamasına yönelik olarak doktrinde ileri sürülen görüşler oluşturmaktadır.	tr_TR
