Abstract

The donatio mortis causa of Roman law was regarded as a special form of conditional gift. As described in Justinians?s Institutes 2.7.1, gift in contemplation of death is one where the donar anticipates dying and gives the thing on the understanding that if he dies the donee shall keep it, but if he survives or changes his mind or the donee passes away first, he shall have it back.
