The Lackness of Simulations and Role-Playing Exercises in TeachingPhilosophy of Law

Abstract

Simülasyonlar ve rol yapma, doktrin odaklı varsayımlar ve canlı istemci klinik programları arasında bir yere düşen tekniklerdir. Hukuk eğitimindeki simülasyonlar arasında bir sözleşme yazılması, bir müvekkille görüşme veya mahkemede tartışmayı içerir. Simülasyonlar genellikle olgu odaklı, etik odaklı ve müvekkil odaklı problem çözmeyi içerir. Bu şekilde özellikle etik odaklı problem çözme hukuk felsefesinin öğretilmesiyle ilgili olacaktır. Hukuk felsefesinin öğretilmesine ilişkin problemleri simülasyonlar ve rol oynama ile çözmemiz gerekiyor. Birçok teorik konunun hukuk öğrencileri üzerinde etkisi olmadığı açıktır. İşte bu pratik çözümlerle tüm teorik bilgilerin gerçek hayata aktarılması mümkündür. Bu yazıda, “Simülasyonların ve Rol Yapma Uygulamalarının Kullanılmasına Yönelik Tartışma”, “Simülasyonları ve Rol Yapma Uygulamalarını Tasarlama” ve ‘Adli Karar Vermeye Giriş’, ‘Hâkim Rolündeki Öğrenciler’ ve ‘Münazara’ gibi “Simülasyonlara Dair Özel Fikirler” konularını tartışacağız.

Simulations and role-playing are techniques that fall somewhere between doctrine-oriented hypotheticals and live-client clinical programs. Simulations in legal education include writing a contract, interviewing a client, or arguing in moot court. Simulations often involve fact- oriented, ethics-oriented, and client-oriented problem solving. In this manner, especially ethics- oriented problem solving will be related to teaching philosophy of law. We need to solve the problems about teaching philosophy of law with the help of simulations and role-playing. It is clear that so many theoretical subjects have no effect on the law students. With this practical solutions it is possible to transfer all the theoretical informations to real life. In this paper we will discuss the topic with “The Argument for Using Simulations and Role- Playing”, “Designing Simulations and Role-Playing Exercises” and “Specific Ideas for Simulations” such as ‘Early Introduction to Judicial Decision-making’, ‘Students as Judges’ and ‘Mooting’
