dc.descriptionThe subject of this study is the foregone breach of construction contract by the contractor before the due date under the article 473 of the Turkish Code of Obligations. This study is composed of three sections. In the first chapter, a general information on construction contract is given. Second chapter is about the right to renege on the contract of the contractee before the due date. In the last chapter, opportunity to recourse to a new contractor by the contractee before the due date is discussed.The topics covered in this study are evaluated with regard to our country's legal system and by taking new regulations into consideration, and a study based on doctrine and practice is aimed by the virtue of court decisions.tr_TR
dc.description.abstractÇalışmamızın konusunu Türk Borçlar Kanunu madde 473 gereğince eser sözleşmelerinde yüklenicinin borca aykırılığının vadeden önce belli olması oluşturmaktadır. Çalışma üç bölümden oluşmaktadır. Birinci bölümde genel olarak eser sözleşmesine değinilmiş, ikinci bölümde iş sahibinin vadeden evvel sözleşmeden dönme hakkı ele alınmıştır. Son bölümde ise, iş sahibinin vadeden evvel yeni bir yükleniciye başvuru imkanı ele alınmıştır. Method olarak, çalışmamızda ele alınan konular, yeni düzenlemeler de göz önünde bulundurularak, ülkemiz hukuk sistemi açısından değerlendirilmiş ve içtihatlardan da yararlanılarak, öğreti ve uygulamayı esas alan bir çalışma hedeflenmiştir.tr_TR
