5237 sayılı Türk Ceza kanununda güveni kötüye kullanma suçu

Abstract

Güveni kötüye kullanma suçu 5237 sayılı Türk Ceza Kanunu'nun 155. maddesinde ve "Malvarlığına Karşı Suçlar" bölümünde düzenlenmiştir. Bu düzenleme ile yasa koyucu kişinin mülkiyet hakkının korunması ve aralarındaki güven ilişkisinin korunmasını amaçlamıştır. Güveni kötüye kullanma suçu failin devir olgusunu inkâr etmesi ya da devir amacı dışında tasarrufta bulunması halinde meydana gelir. Güveni kötüye kullanma suçunun basit halinin takibi şikâyete bağlıdır. Ancak nitelikli hallerin varlığı halinde suçun takibi re'sen yapılır. Güveni kötüye kullanma suçunun yaptırımı olarak kanunda hem hapis cezası hem adli para cezası öngörülmüştür.

The crime of breach of trust is regulated in the article 155 and the section in "Crimes Against Property" of the Turkish Penal Code Law no.5237. The legislator aimed to protect the right of property of the people and the feeling of trust between sides. The crime of breach of trust occurs that obnegation of this transfer or making a disposition out of the purpose of transferring of the perpetrator. The investigation of the simple type of the crime of breach of trust prosecuted on complaint. But the investigation for the quailified types are made of ex officio. As the punishment of the crime of breach of trust both jail sentence and judicial fine are foreseed in the law.
