Abstract

This study explain the implementation, efficiency and operability of the mediation institution which entered our national law with Articel number 5271 Turkish Penal Code. This study aimed to explain the practicability of the mediation institution, how it was operated , the reasons why it couldn't be operated and to examine the mediation institution in details since the day it took affect. It has been evaluated, what should be done in order to the mediation institution usable by introducing it by law enforcers to our law of procedure, why it wasn't operated and the compatibility to our country's social structure.
