Satıcının Zapttan Sorumluluğu

Abstract

Satıcının zapttan sorumluluğu, 6098 sayılı TBK’nun 214 ve 218’inci maddeleri arasında düzenlenmiştir. Zapta karşı sorumluluk, satılan mal üzerinde üçüncü bir kişinin üstün bir hak ileri sürerek malı alıcının elinden almasına ya da söz konusu üstün hak sebebiyle alıcının malı kullanmasına engel olmasına karşı satıcının sorumlu tutulmasıdır. Satım sözleşmesinde satıcının zapttan sorumluluk, satıcının satılan mülkiyetini geçirme borcunun bir sonucu ve müeyyidesidir. Satıcının mülkiyeti geçirme borcunu kısmen veya tamamen yerine getirmemiş olması halinde alıcı, zapttan sorumluluk hükümlerine dayanarak satıcının sorumluluğuna gidebilir.

Quiet enjoyment of the seller is regulated under articles between 214 and 218 of the Turkish Code of Obligations numbered 6098. Quiet eniovment means holding responsible the seller against dissposses of any sold property from buyer, by raising an elder right of any third party on the goods or encumber buyer using the goods by the this elder right. Quit enjoyment of the seller under the sales agreement is a result and also sanction of transferring ownership obligation. If the seller fails to transfer ownership of the sold property totally or partially: it is possible for buyer to hold the seller responsible based on quiet enjoyment provisions.
