Satıcının Ayıptan Sorumluluğu

Abstract

Satıcının ayıptan sorumluluğuna ilişkin hükümler, 6098 sayılı Türk Borçlar Kanunu’nun 219 ve 231’inci maddeleri arasında düzenlenmiştir. Satıcının ayıptan sorumluluğu, satılan maldaki eksiklik veya bozukluklar nedeniyle alıcının o maldan beklenen yararı elde edememesinden satıcının sorumlu olmasıdır. Satıcı, alıcıya karşı, söz verdiği ve bildirdiği niteliklerin satılan malda bulunmamasından sorumlu olduğu gibi böyle bir söz vermediği durumlarda da malın neteliğini etkileyen ve alıcının maldan yararlanmasını ortadan kaldıran eksikliklerin doğurduğu ayıplardan da sorumlu olacaktır. Satılanda ortaya çıkan ayıplar maddi, ekonomik veya hukuki ayıp olarak ifade edilebilir.

The convictions related to the responsibility of the reseller regarding the defects, are regulated in between the 219 and 231 clauses of the Turkish Law of Contract, 6098, The responsibility of the reseller is resulted as a consequence of disutility of the good for the buyer, since the good has defects or malfunctions. The reseller is responsible against the buyer for lack of any qualifications of the good he she expressed to exist, also he she is responsible for any defects that prevents the utilization of the good, resulted as the lack of any qualifications, even in the condition that he she hasn’t expressed.
