TBK m.316 Çerçevesinde Genel Olarak Kİracının Özenli Kullanım ve Komşulara Saygı Gösterme Borcu

Abstract

Türk Borçlar Kanunu’nun 316’ıncı maddesi çerçevesinde kiracı, kiralananı sözleşmeye uygun olarak özenle kullanmak ve kiralananın bulunduğu taşınmazda outran kişiler ile komşulara gerekli saygıyı göstermekle yükümlüdür. Kiracının bu yükümlülüğü, hem taşınır hemde taşınmaz kiralarında mevcuttur. Kiracının, özenle kullanmave komşulara saygı gösterme yükümlülüğü ihalal etmesi halinde, kiraya veren belli şartlarla sözleşmeyi feshedebilecektir. Ayrıca kiraya veren, fesih ile birlikte, sözleşmenin süresinden önce sona ermesinden kaynaklanan müspet zararını kusurlu kiracıdan isteyebilecek ve TBK m.334 uyarınca da kiralananın iadesini talep edebilecektir.

In the frame of Turkish Code of Obligations Art. 316, with respect to the lease contract, a lessee should use the leasehold carefully and she/he is obliged to respect to neighbors and to people with whom she is living with in the property. Obligation of the lessee exists both in transferable and transferable lease. If the lessee violates the obligation of careful usage and respective behaviour to neighbors, the lessor can terminate the contract under certain conditions. Moreover, with the termination of the contract,the lessor can ask for the loss caused by immature termination of the contract from the lessee at fault and according to Turkish Code of Obligations Art. 334, the lessor is able to request the immediate reversion of the lease hold.
