Abstract
The Turkish Criminal Code (no.765) which was in force before 01.07.2005 criminalised the public officials who have not informed that a crime was commited. The Turkish Criminal Code (no.5237) that entered into force in 01.07.2005 provided a general character for this crime and also made a distinction between two seperate crimes, namely the public officials who have not informed that a crime was commited and the health officials who have not informed that a crime was commited. This paper only examines the general characters of this crime, which was recognised with law no 5237 as well as the two distinction crimes mentioned above. In addition, the paper questiones the issue of negligent crimes since the crime of not informing a crime is also considered a negligent crime. The paper sets out examples of implementation as well as different opinions from the doctrine and this crime which does not have wide range of implementation. The paper also highlights the shortcoming whit regard to this type of crime and explores the areas of progress.
