The dissertation is divided into four chapters. The first chapter is devoted to the conceptual and theoretical framework on which the further chapters are built. The first chapter includes the explanations about the concepts; "Higher Education" "University" and "Foundation University". In the theoretical framework section the concept of higher education is subsumed under the public service. The second chapter is devoted to the "Legal Nature of the Higher Education In a Historical Context" Under this title, the developments in Turkish higher education is gauged from a historical viewpoint. The subject of higher education activities since the Ottoman era forms the central theme of this chapter. The third chapter studies the legal status of foundation universities in Turkey within the framework of constitutional and administrative law. Finally fourth chapter first includes the "Organic and Financial Structure" of the foundation universities. Then it goes on to convey the contemporary debate on the reconstruction of higher education in Turkey.Bu doktora tezinin özünü vakıf yükseköğretim kurumlarının kamu hukuku disiplini çerçevesinde bir incelenmesi oluşturmaktadır. Tez dört bölüme ayrılmıştır. İlk bölümde tezin bütününde başvurulacak kavramsal ve kuramsal çerçeve oluşturulmuştur. Bu bölümde Yüksek Öğretim, Üniversite ve "Vakıf Üniversitesi kavramları açıklanmıştır. Kuramsal çerçeve başlığı altında yüksek öğretim hizmetinin bir tür kamu hizmeti olduğu vurgulanmıştır. İkinci bölüm, "Tarihsel Süreçte Yükseköğretim Faaliyetlerinin Hukuki Niteliği" konusuna ayrılmıştır. Bu başlık altında, Türkiye'de yüksek öğretimin gelişimi ve kurumsallaşması tarihsel bir perspektifle incelenmiş ve Osmanlı döneminden bugüne kadar geçen süreçte yüksek öğretim etkinliklerine değinilmiştir. Üçüncü bölümde vakıf üniversitesinin hukuki statüsü anayasa ve idare hukuku çerçevesinde incelenmiş, bu doğrultuda yürürlükteki yasal mevzuat ve yargı kararları irdelenmiştir. Dördüncü bölümünün ilk kısmında Vakıf Üniversitelerinin Organik ve Mali Yapısı ve Bunların Denetim Yolları ile Yükseköğretimin Planlaması konusu ele alınmıştır. Son kısımda ise Türkiye'de yüksek öğretim idaresinin yeniden yapılandırılmasına yönelik çağdaş tartışmalar aktarılmıştır.trHukukLawdoctoralThesis
