Türk Ceza Hukuku’nda, haksıztahrik bir genel düzenleme olarak kaleme alınmıştır dolayısıyla şartlarının vuku bulduğutüm durumlarda uygulanması (Haksız Tahrik’in uygulanması doğası gereği imkansızolan durumlar hariç olmak üzere) gerekir. Mukayeseli Hukuk penceresinden bakıldığında,bazı hukuk sistemlerinde bir genel düzenleme olarak kaleme alınan haksız tahrikdiğer hukuk sistemlerinde ise özel düzenleme olarak belirli suçlar için düzenlenmiştir.Ancak genel düzenleme olarak düzenlenmediği sistemlerde dahi verilecek makul cezanınbelirlenmesinde dikkate alınması gereken bir durum olduğu Kabul edilmektedir.Bu çalışmamızda, failin bir suçu mağdurun eylemlerinin psikolojik etkisi altındaiken işlemesi; Haksız Tahrik’in bir genel düzenleme olarak düzenlenmesinin gerekliliğive son olarak Haksız Tahrik’in mukayeseli hukuktaki uygulaması inceleme konusu yapılmıştır.Publication Participant Design Experience: A Design Proposal on the Example of IKU Akpaz Cafeteria = Katılımcı Tasarım Deneyı̇mı̇: İKÜ Akpaz Kafeterya Örneğı̇ Üzerı̇ne Bı̇r Tasarım Önerı̇sı̇(Anadolu University, 2021) BERZE, İPEK; YAZICI, YASEMİN ERKANParticipation, which is a democratic understanding revises itself in the field of architecture. As opposed to established design process which takes the designer at the center, independent participatory approach takes the designer to the center and currently has a humanist understanding. It is aimed to prevent individuals from interfering with the designs after the project is implemented by taking more care of human needs. Collaborative design approach developed to minimize interventions in the physical environment is an active process guided by space users. In addition, participatory methods developed to understand the needs of users are effective in making the process democratic and sustaining projects. In this study, Istanbul Kultur University Akpaz Cafeteria was aimed to be redesigned with a participatory approach using the daily life experiences of users. Although it is university dining hall area, Akpaz Cafeteria is preferred for various purposes other than dining area by the users who have many different expectation, Akpaz Cafeteria is selected as an example for this study. The observations made to analyze the instant behavior of the users and the semi-structured interview questions directed to reveal the implicit expectations and experiences of the students constituted the participatory design methods used in the study. At the end of the study, the observations made by the designers and the interviews with the users were analyzed, and the Akpaz Cafeteria area was redesigned with the help of the findings.Publication Rising Damp Treatment in Historical Buildings by Electro-Osmosis: A Case Study(MDPI, 2024) Koca, Aliihsan; UĞURAL, MEHMET NURETTİN; YAMAN, ERGÜNThroughout the past century, numerous technologies have been suggested to deal with the capillary rise of water through the soil in historic masonry buildings. The aim of this study was to examine the effectiveness of capillary moisture repulsion apparatus that uses the electro-osmosis approach over a prolonged period of time. The G & uuml;l mosque was selected as a sample historical building affected by structural problems caused by the absorption of water through small channels on its walls due to capillary action. The moisture repulsion mechanism efficiently decreased the moisture level in the walls from a 'wet' state to a 'dry' state in roughly 9 months. After the installation of the equipment, the water mass ratio of the building decreased from 14.48% to 2.90%. It was determined that the majority of the water in the building was relocated during the initial measurement period. Furthermore, it inhibited the absorption of water by capillary action by protecting the construction elements that were in contact with the wet ground. Lastly, capillary water repulsion coefficients (C) for various measurement durations and time factors were proposed. The average value of C was calculated to be 0.152 kg/m2 s0.5 by measuring the point at which the water repulsion remained nearly constant.Publication Triggering Corporate Sustainable Performance in Construction Sector through Green Training: Moderating Effect of Barrier in Construction Management(Yıldız Teknik Üniversitesi Rektörlüğü, 2023) WARIS, IMRAN; ÜLKÜ, İLAYDAConstruction barrier plays a significant but negative role-play between green training and corporate sustainability performance due to limited resources. The research question in this study is to explore the relationship between green training and sustainable performance in the construction industry, while also considering the moderating role of construction barriers. This study gives extensive knowledge of green training and corporate sustainability performance. Data is obtained from 225 employees using a convenience sampling technique from the construction sector. The research employed SPSS/PROCESS and follows a cross-sectional research design. Study findings show green training is an antecedent of the sustainable performance of the construction sector. The result shows that Green training significantly and positive role-play in sustainable performance. Person-organization fit theory covers the whole phenomenon. That focuses on productivity, performance, and personal well-being. Under P-O fit theory results are showing the compatibility between a person and an organization where they are doing work. This study's results highlight the green training that transforms the em- employee’s mindset towards corporate sustainable performance. In the future, need longitudinal studies that will be more acceptable. This study provides insights to the managers, policymakers, and practitioners of sustainable environment and performance. The current study will help economies in the developing world, such as Pakistan.Publication Varagavank Monastery’s Khachkar Motifs: Understanding Production Through Parametric Methods(Birkhauser, 2023) BAYER, SEMİH; Çakıcı Alp, NeşeThis study investigates the traditional religious architecture through the examination of Armenian Khachkar motifs at Varagavank Monastery in Van, Turkey. “Khachkar” is pivotal within Armenian religious architecture, denoting a minor architectural style and symbolising “cross-stone.” The study employs a parametric identification method to extract the fundamental unit of Khachkar motifs and develop a model to explore various variations. By utilising a mathematical analysis, the research showcases the practicality of this approach in facilitating diverse transformations within intricate designs. The study offers a comprehensive analysis of the built heritage found in Armenian religious architecture, enhancing the understanding and appreciation of these cultural artefacts. The findings of this study on Khachkars make valuable contributions to architectural research and deepen our comprehension of their significance in Armenian religious art.
